When I cam back to work after my pregnancy leave, my company demoted me to a position with less responsibility and a lower salary. Apparently they found another person to fill my place while I was away and I have the feeling they only kept me at all because they aren't allowed to fire me.

I find the whole situation disghusting. What are my rights with regards to keeping my old position?

Hi there,

Swiss law prevents employers from terminating your contract during pregnancy or the first 16 weeks following childbirth.

While this generally applies to terminating a woman's employement, if a demotion results in a change of your contract, your employer may be acting illegally and you should speak to a lawyer about your legal options.

If - on the other hand - your new position and salary is in keeping with the conditions laid out in your employment agreement, then your employers may be within their rights.
