I have a growing debt which I am unable to pay as I am surviving on a disability pension. A debt collector recently led me to believe that part of my income could be seized to repay my debt. I am already barely surviving as it is. Can they claim my pension?

Hi there,

Social security pensions cannot be seized to repay debts owed by their recipient because these pensions guarantee a basic living.

Assets which can be seized for the repayment of debt include:

- Salaries
- Income generated through self-employment
- Unemployment insurance benefits
- Pensions or withdrawals from your occupational pension (2a) or private retirement assets (3a).
- Real estate
- Movable property
