We own an apartment which we rent out earn income. The last tenants left the place a wreck and we have been dealing with their personal liability insurance. The problem is that the insurance company did not pay us the full amount of money owed but only the part above the tenant's deductible.

Their deductible is high so the missing sum comes to several thousand francs. We would rather not be the ones to chase the tenant for the money. Shouldn't the insurance company pay us the full amount owed and then chase the tenant for the deductible?

Greetings,

The tenant bears liability for the damage which they inflict on your property. Their personal liability insurance provider covers part of their liability as part of a personal agreement between the tenant and their insurance provider. Their insurer only covers liability up to the limits agreed on in their insurance policy.

In your case, the tenant is liable to cover all costs which are not covered by their personal liability insurance provider. If they refuse to pay the money owed, you can open a case at the applicable debt collection office.
