Good day,

I am developing a product and expect to begin manufacturing and marketing it shortly. I would like to brand the product as being made in Switzerland. What are the requirements (if any) for including that branding? My business will be headquartered in Switzerland.

Hi there,

In every case, your business will have to be headquartered in Switzerland in order to market products as being Swiss (including the presence of the Swiss flag in branding). Additional guidelines for labeling products as Swiss are as follows:

1. Depending on the product in question, agricultural produce and other raw materials can be labeled as Swiss if they are harvested in Switzerland or extracted in Switzerland.

2. Manufactured goods can be labeled as Swiss if at least 60% of costs related to their manufacture are incurred in Switzerland and the bulk of manufacturing takes place in Switzerland.

3. Food can be labeled as Swiss if at least 80% of ingredients and 100% of milk products originate in Switzerland and the bulk of food processing activities are performed in Switzerland.

These criteria are legally binding. The Swiss Federal Institute of Intellectual Property may press charges against any entity which acts in breech of these rules.
