I own an apartment in a building which has a penthouse on the top floor. Recently, the penthouse’s owner has asked all of us co-owners to pitch in for the cost of renovating the roof terrace. I can’t imagine that I would have to pay to renovate a terrace which only they can use. How does this work legally?

The roof of the condominium is common property, meaning that it belongs to all of a building’s owners collectively. If a terrace makes up the roof, all of the building's co-owners are required to cover the cost of renovation even if only one owner has access to the terrace.

If your building has a building renovation fund, the cost of repairing the roof will normally be covered by that fund.
