I am employed on a 50% basis but in practice I work at least 60%. Can I claim extra pay for the overtime?

Hi there,

If your employer requests that you work overtime, they are required by Swiss law to either pay you for the overtime at your regular hourly rate plus a 25% bonus (your employment contract may include a clause which exempts your employer from paying the 25% bonus), or to compensate you with time off from work equivalent to the amount of overtime you put in.

However, if you work overtime on a voluntary basis without being asked to do so by your employer, you are not entitled to overtime pay.

In your case, the defining factor is whether or not you are requested to work overtime by your employer.
