Our rented house has a swimming pool in the garden, which is lovely. But because our garden isn't walled in and the neighbors have small kids, we feel pretty uneasy about the risk of a kid wandering into our garden and falling in the pool. Besides the tragedy of a kid drowning or sustaining damage, there is also the financial aspect. Could we be sued? Would we be liable?

Hi there,

Responsibility to correctly secure permanent swimming pools, ponds and other artificial bodies of water falls with homeowners. Due dilligence includes all measures necesarry to ensure that very young children cannot access the pool (by installing a fence or a pool cover, for example).

Liability only falls on you as a renter if the landlord has met all necessary precautions when constructing the pool. It is part of your due dilligence responsibilities as a renter to make sure that safety measures are observed (by locking gates or replacing pool covers after use, for example).
