K-Tipp Legal Protection

Legal protection provided by the K-Tipp group.

Within the scope of individual insurance: the policyholder. Within the scope of household insurance: the policyholder and those persons who living permanently with him/her in the same household. Additionally: children in education and minor children of these persons, even if they do not live in the same household (up to the age of 25).

Stamp taxes of 5 percent included.

Choice of legal representation: the insurance company has the right to reject a lawyer proposed by the insured person. The insured person may then propose three lawyers from different law firms in the relevant jurisdiction, from which the insurance company can select the lawyer to be appointed.

The insurer can terminate the contract: at the latest 1 month before the end of the contract or insurance year. After every insured event for which a claim is payable.

Minimum contract duration: 1 year. The contract will automatically renew for another year unless termination notice is given 1 month in advance.

A waiting period of 3 months applies to contractual disputes, 12 months to disputes with the disability insurance. The waiting period does not apply if the same risk was covered by another insurer until the start of the contract with K-Tipp Rechtsschutz AG.

No minimum amount in dispute.

Special coverages: victim support; tax law; social insurance law; real estate law. A premium mark-up applies to real estate law coverage.

Also insured are all legal disputes under Swiss law up to an amount in dispute of CHF 10,000, where representation vis-à-vis the opposing party is possible by in-house lawyers of K-Tipp Rechtsschutz.

Exclusions (examples): If the driver was not authorized to drive the vehicle. Disputes that involve drugs or alcohol. When acquiring or re-acquiring a driver’s license.

Unlimited telephone consultation by the internal consultation service in the other areas of law. Writing assistance.

Legal coverage for homeowners can be added for an additional 30 francs per year. Special services include: debt collection cost coverage; cash advances for bails in the case of criminal
negligence. 

An out-of-court intervention with the other party, even if there is no dispute yet. This includes, among other things, the examination and explanation of the legal situation, the study of the file and the drafting and sending of the intervention letter.
